Limited Consumer Product Warranty Agreement

Effective Date: This warranty is effective as of the date of your original purchase.

You must register your warranty within 30 days of placing your order in order for it to take effect.

Warranty Coverage by Product

Living Well Solutions, LLC (“Sans,” “we,” “us,” or “our”) warrants the following products against defects in materials and workmanship under normal use for the periods specified below from the date of original purchase (“Warranty Period”):

Note: Replacement filters, accessories, and consumable parts are not covered under this warranty.

What This Warranty Covers

During the applicable Warranty Period and subject to the terms and conditions of this Warranty Policy, Sans will, in its sole and exclusive discretion, either: (i) repair the defect at no charge using new or refurbished replacement parts; or (ii) replace the product with a new or refurbished product of equal or greater value. Replacement parts and products are warranted for the remainder of the original Warranty Period or ninety (90) days, whichever is longer.

Who Is Covered

This limited warranty extends only to the original consumer purchaser of the product and is not transferable to any subsequent owner. The original purchaser must provide: (a) verification of the defect or malfunction; and (b) proof of the date of purchase (such as a receipt or order confirmation) to claim warranty benefits.

For air and water purifiers, to maintain warranty eligibility, filters must have been replaced according to the recommended schedule (typically every 3-6 months depending on usage and product type, as specified in your product's user manual).

What This Warranty Does Not Cover

This warranty does not apply to:

• Consumable parts and accessories, including but not limited to filters, UV bulbs, seals, gaskets, and batteries, which are subject to normal wear and depletion;
• Cosmetic damage, including scratches, dents, and broken plastic, that does not affect functionality;
• Products with proof-of-purchase that has been altered, defaced, or made illegible;
• Products with model numbers, serial numbers, or production date codes that have been removed, altered, or made illegible;
• Products that have been modified, altered, or tampered with from their original condition;
• Damage caused by failure to follow product instructions, user manuals, or care guidelines;
• Damage caused by use with non-approved peripherals, accessories, or third-party components;
• Damage caused by accident, misuse, abuse, neglect, unauthorized repair, or improper maintenance;
• Damage caused by service or repair performed by anyone other than Sans or a Sans-authorized service provider;
• Products used for commercial, rental, institutional, or any non-residential purpose;
• Damage caused by external factors including but not limited to: power surges, lightning, abnormal voltage, fire, flood, earthquake, or other natural disasters; exposure to extreme temperatures; animal damage; improper storage or transportation;
• Damage caused by use with water sources that do not meet the product specifications (for water products);
• Normal wear and tear;
• Incidental, consequential, special, or punitive damages of any kind.

How to Make a Warranty Claim

1. Verify eligibility: Confirm your product is within the applicable Warranty Period listed above.
2. Gather documentation: Locate your original proof of purchase (receipt, order confirmation, or invoice).
3. Retain your product: DO NOT dispose of or discard your product before contacting us.
4. Contact us: Email our Customer Support team at support@livesans.com with a description of the issue and your proof of purchase.
5. Follow instructions: Once your claim is approved, follow the return instructions provided. You may be responsible for shipping costs to return the product.

Legal Terms and Conditions

SOLE AND EXCLUSIVE REMEDY. THE REPAIR OR REPLACEMENT OF A DEFECTIVE PRODUCT AS PROVIDED HEREIN IS YOUR SOLE AND EXCLUSIVE REMEDY AND CONSTITUTES LIVING WELL SOLUTIONS' ENTIRE LIABILITY FOR ANY BREACH OF THIS WARRANTY. THIS WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY. NO EMPLOYEE, AGENT, DEALER, OR OTHER PARTY IS AUTHORIZED TO MODIFY OR EXTEND THIS WARRANTY OR TO MAKE ANY WARRANTY IN ADDITION TO THIS WARRANTY ON BEHALF OF LIVING WELL SOLUTIONS.

DISCLAIMER OF WARRANTIES. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, LIVING WELL SOLUTIONS EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED IN THIS WARRANTY, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LIVING WELL SOLUTIONS DOES NOT WARRANT THAT THE PRODUCT WILL MEET YOUR REQUIREMENTS OR THAT OPERATION OF THE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIVING WELL SOLUTIONS, ITS AFFILIATES, SUBSIDIARIES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR: (A) ANY AMOUNT IN EXCESS OF THE ORIGINAL PURCHASE PRICE OF THE PRODUCT; OR (B) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE PRODUCT, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND EVEN IF LIVING WELL SOLUTIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CONSUMER RIGHTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION. NOTHING IN THIS WARRANTY SHALL AFFECT ANY STATUTORY RIGHTS THAT CANNOT BE WAIVED OR LIMITED BY CONTRACT.

GOVERNING LAW. THIS WARRANTY AND ANY DISPUTES ARISING OUT OF OR RELATING TO THIS WARRANTY OR THE PRODUCTS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF DELAWARE, UNITED STATES, WITHOUT REGARD TO ITS CONFLICT OF LAWS PRINCIPLES. ANY LEGAL ACTION OR PROCEEDING ARISING UNDER THIS WARRANTY SHALL BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED IN DELAWARE, AND THE PARTIES HEREBY CONSENT TO PERSONAL JURISDICTION AND VENUE THEREIN.

SEVERABILITY. IF ANY PROVISION OF THIS WARRANTY IS HELD TO BE INVALID, ILLEGAL, OR UNENFORCEABLE, THE REMAINING PROVISIONS SHALL CONTINUE IN FULL FORCE AND EFFECT.

MODIFICATION. LIVING WELL SOLUTIONS RESERVES THE RIGHT TO MODIFY THIS WARRANTY AT ANY TIME. ANY CHANGES WILL APPLY ONLY TO PRODUCTS PURCHASED AFTER THE EFFECTIVE DATE OF THE MODIFICATION AND WILL NOT AFFECT WARRANTIES FOR PRODUCTS ALREADY PURCHASED.

ENTIRE AGREEMENT. THIS WARRANTY CONSTITUTES THE ENTIRE AGREEMENT BETWEEN YOU AND LIVING WELL SOLUTIONS WITH RESPECT TO THE WARRANTY OF THE PRODUCTS AND SUPERSEDES ALL PRIOR OR CONTEMPORANEOUS UNDERSTANDINGS REGARDING SUCH SUBJECT MATTER.
